Aggarwal Associates is a firm of advocates whose practice extends to the courts, tribunals and authorities at Chandigarh. The firm's advocates appear as counsel in civil, criminal, family, constitutional, consumer, banking, corporate and arbitral matters before the forums listed below, and act as a lawyer in Chandigarh for clients whose matters lie within the jurisdiction of those forums. Territorial Jurisdiction in the Tricity
Chandigarh is a Union Territory administered by the Central Government through the Administrator. Panchkula is a district of the State of Haryana, and Mohali (SAS Nagar) lies in Punjab. The Punjab and Haryana High Court is the common High Court for all three. Below the High Court, the position differs in the following respects:
- Police. An offence within Chandigarh is registered at a Chandigarh Police station, one in Panchkula at a Haryana Police station, and one in Mohali at a Punjab Police station. The station at which the FIR is registered determines the court that takes cognizance.
- Courts. Trial courts are organised by district. The courts of Chandigarh sit in Sector 43, and those of Panchkula in Sector 1, Panchkula.
- Local laws and authorities. Rent, property, stamp duty, land revenue and municipal laws differ among the Union Territory, Haryana and Punjab. Property matters in Chandigarh concern the Chandigarh Administration and the Estate Office, while plots in Panchkula may concern HSVP.
The forum for a particular proceeding is determined by the governing statute:
- Criminal cases. Inquiry and trial ordinarily take place in the court within whose local limits the offence was committed (Section 197 of the Bharatiya Nagarik Suraksha Sanhita, 2023, formerly Section 177 of the Code of Criminal Procedure).
- Matrimonial petitions. Under Section 19 of the Hindu Marriage Act, 1955, a petition may be presented where the marriage was solemnised, where the parties last resided together, or where the wife resides, among other grounds. Depending on residence, the Family Court at Chandigarh or at Panchkula may therefore have jurisdiction.
- Civil suits. Under Section 20 of the Code of Civil Procedure, 1908, a suit is instituted where the defendant resides or carries on business, or where the cause of action arises. Suits relating to immovable property are governed by Sections 16 to 18.
- Consumer complaints. Under Section 34 of the Consumer Protection Act, 2019, a complaint may be filed where the opposite party resides or carries on business, or where the complainant resides or personally works for gain.
- Recovery and company matters. The territorial jurisdiction of each DRT and NCLT bench is notified by the Central Government. The Chandigarh DRT and the Chandigarh Bench of the NCLT hear matters arising in this region.

Must an advocate have chambers in the same city as the court?
No. An advocate enrolled with a State Bar Council may practise before any court in India. What matters is that the proceeding is instituted in the court or tribunal that has jurisdiction.
Which court hears a divorce petition where the husband resides in Chandigarh and the wife in Panchkula?
The answer depends on Section 19 of the Hindu Marriage Act, 1955, or the corresponding provision of the personal law that applies, and on facts such as where the marriage was solemnised and where the parties last resided together. The Family Court at either Chandigarh or Panchkula may have jurisdiction.
Can proceedings on an FIR registered in Chandigarh be taken up in the Panchkula courts?

Where is a consumer complaint filed?
A complaint is filed before the District Commission having jurisdiction under Section 34 of the Consumer Protection Act, 2019. An appeal from its order lies to the State Commission.
